Terms and Conditions for Photography Services for Artwork

1. Consent: The photographer must secure written consent from the artist before photographing their artwork (this is done via booking form).
2. Copyright: The photograph is the copyright of the photographer, and the artist retains the copyright of the paintings. If the photographer wishes to use the photograph of the painting for commercial purposes, they may need to obtain the artist’s consent, depending on the specific use and the application of the ‘fair dealing’ provisions under UK copyright law.
3. Image Integrity: The photographer must not crop or edit the images in a manner that would compromise the artist’s original intent or the artwork’s integrity.
4. Resolution and Format: The images must be supplied in high resolution and a format appropriate for the artist’s purposes.
5. Commercial Use: For any commercial exploitation of the images, such as advertising or print sales, the photographer must obtain an additional release from the artist.
6. Attribution: The artist must be credited by the photographer whenever the images are used or displayed.
7. Insurance: The artist is responsible for ensuring the artwork is safeguarded during the photography process and must possess insurance to cover potential damages.
8. Amendment of Terms and Conditions: The photographer reserves the right to modify these terms and conditions at any time without notifying the artist.
9. Colour Correction: The photographer shall deliver colour-corrected images utilizing industry-standard correction software.
10. File Formats: The images will be provided in file formats that suit the artist’s requirements, such as JPEG, TIFF, BMP, or PNG.
11. File Size: The images will be supplied in file sizes appropriate for the artist’s needs, including print or web use.
12. Booking Fee: The base charge for photography services is £50, which constitutes a non-refundable booking fee covering five paintings. Additional paintings will incur a charge of £10 per image.
13. Payment: The artist will be invoiced by the photographer for the services provided and must settle the invoice upon receipt. The photographer will withhold the images until the invoice is paid in full.
14. Rescheduling: If the artist needs to reschedule the photography services, they must provide written notice to the photographer no less than 48 hours before the scheduled photography date. We will work together to find a new date and time that works for both of us.
