Standard Usage Rights
Foyers Photography
This page sets out the standard usage rights that apply to all images produced by Foyers Photography. It is provided to give clients a clear and complete understanding of what they can and cannot do with the images from their session or commission. These terms apply unless a separate written agreement is in place.
When your licence begins
Your usage rights take effect once your invoice has been settled in full. Until full payment is received, no licence to use the images is granted. This applies to all formats, including digital files, low-resolution previews, and any images shared for approval purposes prior to final delivery.
What your standard licence covers
Once payment is complete, your business is licensed to use the final edited images for the following purposes:
- Your own website and online presence
- Your own social media channels
- Printed marketing materials, including brochures, flyers, banners, and business cards
- Internal communications, including presentations, reports, and staff materials
- Digital advertising on platforms you own or manage directly
This licence is granted to your business as named on the invoice. It applies for an unlimited duration unless otherwise stated in your contract.
What your standard licence does not cover
The following uses are not included in the standard licence. Each requires a separate written agreement with Foyers Photography before use.
- Third-party use. The images are licensed to your business only. They cannot be passed to, sold to, or used by any other company or individual, including agencies, partners, or third-party suppliers, without written permission from Foyers Photography.
- Sub-licensing. You may not grant permission to any other party to use the images. Only Foyers Photography can authorise additional licences.
- Resale. The images may not be sold, transferred, or used as a commercial product in their own right.
- Stock use. Images may not be submitted to stock libraries or any platform for third-party distribution or resale.
- Editorial use in third-party publications. Use in magazines, newspapers, or other publications you do not own or control requires a separate licence.
- Use by associated businesses. Parent companies, subsidiaries, holding companies, and related entities are treated as separate third parties. Use by any of these requires written permission.
- Campaign or territorial extension. If your original licence was for a specific campaign or territory and you wish to extend use beyond that scope, a new agreement is required before that extended use begins.
Copyright
Foyers Photography retains copyright over all images at all times. This is standard practice in professional commercial photography and is not specific to your commission.
Your licence gives you the right to use the images as described above. It does not transfer ownership of the images or the copyright in them. The original image files, including raw files and unedited captures, remain the property of Foyers Photography.
Use of images outside the terms of your licence is a breach of copyright and will be treated accordingly.
Portfolio and promotional use by Foyers Photography
Foyers Photography retains the right to use final edited images in its own portfolio, website, social media channels, and marketing materials. This is standard practice in the photography industry.
If you would prefer your images to remain private and not be used in this way, this must be raised and agreed in writing before your shoot date. A confidentiality arrangement may affect the session fee. Verbal requests cannot be accepted; written confirmation is required in all cases.
Extended licensing
If you need rights beyond the standard licence, extended licensing is available. This includes but is not limited to:
- Exclusive use rights
- Rights covering additional territories
- Multi-campaign use
- Use by associated or third-party businesses
- Full buyout arrangements
Extended licensing is quoted separately and must be agreed in writing before the shoot where possible, as licensing requirements can affect how images are captured and delivered. Retrospective extended licensing requests are considered but may carry a higher fee.
If you are unsure
If you are not certain whether a specific use is covered by your standard licence, contact Foyers Photography before using the images. It is always better to check in advance. Proceeding without confirmation does not constitute permission.
